PAS Secretary-General Datuk Seri Takiyuddin Hassan said the Kuala Lumpur High Court’s decision to reject Datuk Seri Najib Razak’s application for house arrest must always be respected as one of the main pillars of the rule of law.
However, he said such respect should not negate the right and freedom of expression guaranteed under the Federal Constitution.
“PAS viewed the court’s decision seriously in rejecting Datuk Seri Najib Razak’s application for a judicial review to serve the remainder of his prison sentence under house arrest, following the issuance of an Addendum Order by the 16th Yang di-Pertuan Agong.
“We also acknowledged that decisions of the judiciary must always be respected as one of the main pillars of the rule of law,” he said.
Based on these principles, Takiyuddin said Pas fully supported Datuk Seri Najib Razak’s right to file an appeal to a higher court, in line with the right of appeal as a fundamental guarantee and protection for every individual.
“In conclusion, Pas urges all branches of government and relevant authorities to act courageously, transparently and faithfully in accordance with constitutional principles to ensure that justice is upheld consistently, and that the honour and sovereignty of the Yang di-Pertuan Agong and the rulers continue to be preserved,” he added.
