Dr Khairul Hakim, one of the Hospital Kuala Lumpur doctors who had examined Mohd Saiful Bukhari Azlan on June 28, 2008, admitted today that Saiful\u2019s testimony \u2014 based on the proforma report \u2014 had only stated \u201cattempted\u201d sodomy and oral sex.<\/p>\n
Anwar\u2019s defence counsel, Karpal Singh, argued today that this proved that the charge was groundless.<\/p>\n
He said that under the criminal procedure code, only Attorney-General Tan Sri Abdul Gani Patail could withdraw the charge.<\/p>\n
\u201cIn light of recent evidence it is obvious that the charge is groundless. The proforma report clearly shows that Saiful had complained of attempted sodomy and oral sex, this contradicts his own claims.<\/p>\n
\u201cI call on the AG to withdraw the charge to avoid further embarrassment to the country. In the course of the prosecution, we have different versions concerning fundamental issues in this trial,\u201d Karpal told reporters.<\/p>\n
Anwar, who was also present, said that the new evidence proved that his prosecution was \u201ctrumped up, frivolous and baseless.\u201d<\/p>\n

Previous News – <\/strong>\u2018Attempted\u2019 sodomy, no actual penetration of Saiful, says report<\/strong><\/p>\n An initial medical report revealed that Mohd Saiful Bukhari Azlan had told Hospital Kuala Lumpur (HKL) doctors that Datuk Seri Anwar Ibrahim had \u201cattempted\u201d to sodomise him, but no actual penetration had taken place.<\/p>\n Dr Khairul Hakim, one of the HKL doctors who had examined him admitted today that the proforma report stated that Saiful had told examining doctors on June 28,2008 that there was \u201cattempted\u201d sodomy and oral sex, but not actual penetration.<\/p>\n Khairul however insisted that Saiful did not say this to him when the latter met him, and maintained that Saiful had told him he was sodomised.<\/p>\n \u201cBased on the proforma report, it was attempted sodomy and oral sex. But he (Saiful) did not say it was attempted,\u201d said Khairul.<\/p>\n This led defence counsel Karpal Singh to ask Khairul the merits of the report.<\/p>\n \u201cIs a proforma report on based on wha SP1 (Saiful) said? Based on the proforma report, there could not have been any penetration because it was attempted,\u201d said Karpal.<\/p>\n Anwar, the 62-year-old PKR de facto leader, is currently facing sodomy charges for the second time in his life.<\/p>\n The former deputy prime minister is charged with sodomising a former aide, Mohd Saiful Bukhari Azlan at Unit 11-5-1 of the Desa Damansara Condominium in Jalan Setiakasih, Bukit Damansara here between 3.01pm and 4.30pm on June 26, 2008.<\/p>\n Anwar has denied the charge, describing it as \u201cevil, frivolous lies by those in power\u201d when the charge was read out to him. He is charged under section 377B of the Penal Code and can be sentenced to a maximum of 20 years\u2019 jail and whipping upon conviction. The trial is taking place 18 months after Anwar was charged in court in August 2008.<\/p>\n He was charged with sodomy and corruption in 1998 after he was sacked from the Cabinet and was later convicted and jailed for both offences.
