{"id":26062,"date":"2014-09-11T19:34:15","date_gmt":"2014-09-11T11:34:15","guid":{"rendered":"http:\/\/www.buletinonline.net\/v7\/?p=26062"},"modified":"2014-09-12T01:43:19","modified_gmt":"2014-09-11T17:43:19","slug":"pas-president-syura-violate-pas-law","status":"publish","type":"post","link":"https:\/\/buletinonlines.net\/v7\/index.php\/pas-president-syura-violate-pas-law\/","title":{"rendered":"PAS&#8217; President, Syura Did Not Violate PAS Law"},"content":{"rendered":"<p>PAS Legal Unit in Terengganu have disagreed with their national legal bureau (LUHAM), insisting president Datuk Seri Abdul Hadi Awang and the Syura Council had not acted beyond their constitutional powers in unilaterally naming the candidates for Selangor mentri besar to the Sultan.<\/p>\n<p>According to the Terengganu bureau, the supreme law in PAS is not the party constitution but the religion of Islam and its holy texts.<\/p>\n<p>The party\u2019s Syura Council, the bureau said, can overrule the decision of its highest authority, which is the annual congress, or muktamar.<\/p>\n<p>It also said that the Terengganu chapter had not been present during the drafting of LUHAM\u2019s statement released on September 9. The bureau previously said its official statement was made collectively.<\/p>\n<p>Terengganu chapter statement was signed by Mohd Saifudin Othman (Chairman Luham PAS Negeri Terengganu), Fathi \u2018Aziz Bin Abu Bakar (Chairman  Juham Dewan Pemuda Pas Negeri Terengganu with their committee members Mohd Kamaruzaman Bin A Wahab and Mohd Zabidi Bin Yusof <\/p>\n<p>\u201cUnder the PAS constitution, the council acts as \u2018the guardian of Islam and constitution\u2019, which allows it to supercede the decision of any bodies in PAS including the muktamar if such decisions go against PAS\u2019 policies and Islamic moral code,\u201d said the statement by the Terengganu LUHAM chapter.<\/p>\n<p>\u201cTherefore, the role of the council is as a \u2018supervisory body\u2019 to every organisation in PAS not just as a \u2018referral body\u2019,\u201d it added.<\/p>\n<p>\u201cUnder Article 8(1)(b), the council can issue orders and commands so that any policy and resolution is obeyed and implemented by any individual or body in PAS.
