Zoo Bukit Takal; Kemaman Municipal Council Defamation Suit, Dismissed

KUALA LUMPUR: The High Court here today dismissed a RM5 million defamation suit by the Kemaman Municipal Council (MPK) against PAS over defamatory words on the issue of the Bukit Takal Zoo in Terengganu.

Judicial Commissioner Rosilah Yop, in her ruling, held that the MPK had failed to prove the element of defamation in the case. Counsel Noorazmir Zakaria, representing PAS, told the media that the judge said the MPK had failed to prove that the defamatory statements were published by PAS against the council.

Counsel Azwan Abdul Wahab represented the municipal council.

On March 22 last year, MPK filed the suit against PAS seeking RM5 million in damages from the party which it claimed had distributed pamphlets containing false and defamatory words on the Bukit Takal Zoo issue.

On July 23 last year, the High Court granted PAS’s application to set aside a judgment in default order served on the party. MPK had filed the application for a default judgment against the party after it failed to appear twice in court despite being ordered to do so. – Bernama
