Kelantan govt to re-table 16 syariah provisions struck down by Federal Court

PASIR MAS: The Kelantan government will re-table 16 provisions under the Kelantan Syariah Criminal Code (I) Enactment that were previously struck down by the Federal Court at the next state assembly sitting.

Menteri Besar Datuk Mohd Nassuruddin Daud said the proposal had already received the state executive council’s approval.

“We will table them again for approval. Our struggle is a righteous one. We will not give up. Others may invalidate them, but we will bring them back (to the state assembly),” he said.

Nassuruddin was speaking at the Pasir Mas Pas annual general meeting, which was officiated by Pas deputy president Datuk Seri Tuan Ibrahim Tuan Man.

In 2024, the Federal Court declared 16 offences under the Kelantan Syariah Criminal Code (I) Enactment unconstitutional and invalid.

An eight-member panel chaired by then chief justice Tun Tengku Maimun Tuan Mat made the ruling after allowing a petition filed by lawyer Nik Elin Zurina Nik Abdul Rashid and her daughter, Tengku Yasmin Nastasha Tengku Abdul Rahman.

Delivering the court’s judgment, Tengku Maimun said the petition was allowed because the Kelantan state assembly had enacted laws beyond its legislative powers.

The 16 provisions include offences already covered under federal law, including sodomy, sexual harassment, gambling and incest, among others. – NST
